1. ELIGIBILITY: This Sweepstakes is open to legal residents of the United States (Alaska, Puerto Rico and Guam are excluded), who are 21 years of age or older at time of entry and reside in the serviceable area of a participating cable system that is participating in this Sweepstakes (each, a “Participating System”). To determine whether you reside in the serviceable area of a Participating System, visit www.oxygen.com and click on the “For a list of Participating Systems” pull-down menu bar. Employees of NBC UNIVERSAL TELEVISION NETWORKS DISTRIBUTION (“Sponsor”), Participating Systems and any participating retailers (“Promotional Partners”), Big Fish Marketing, Inc. (“Administrator”), and each of their respective parent, affiliates, subsidiaries, advertising and promotional agencies and each of their respective officers, directors, employees, and agents (together, "Sponsor and its Agents") and members of the immediate family and persons living in the same household of each are ineligible. This Sweepstakes will end at 11:59:59 PM (ET) on June 17, 2008.
2. TO ENTER: TORI & DEAN SWEEPSTAKES ("Sweepstakes") will run between May 19, 2008–June 17, 2008 (“Promotion Period”). Beginning at 12:00:00 AM (ET) on May 19, 2008 and ending at 11:59:59 PM (ET) on June 17, 2008, you may enter the Sweepstakes online by visiting www.oxygen.com and completing the online entry form. You must provide your first name, last name, street address (no P.O. Boxes), city, state, ZIP code, daytime telephone number, age, email address, cable service provider (if applicable) and click the “submit” button to complete your entry (the “Entry”). To determine if your local cable system is a Participating System in this Sweepstakes, check online by following the procedure described in Paragraph 1 above, or call or visit your local cable service provider. Normal Internet access and usage charges imposed by your online service may apply. All Entries received online must be received by 11:59:59 PM (ET) on June 17, 2008. No automated entries allowed. Limit one entry per person/e-mail address. Sponsor and its Agents assume no responsibility for technical, hardware or software malfunctions of any kind, or unavailable network or Internet service provider connections, failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate or by any human error which may occur in the processing of the Entries in this Sweepstakes. Sponsor is not responsible for lost, late, incomplete, misdirected, stolen, illegible entries, address changes of entrants or entries not received in time for the drawings. Sponsor reserves the right to cancel the Sweepstakes if it becomes technically corrupted, and award prizes from eligible Entries received prior to cancellation. In the event of a dispute regarding the identity of the person submitting an online Entry, the Entry will be deemed to be submitted by the person in whose name the e mail account is registered. Entries become the property of Sponsor and will not be returned. Sponsor reserves the right, at its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of these Sweepstakes, or to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse threaten or harass any other person. 3. DRAWING: One (1) Grand Prize Winner per Participating System will be selected in random drawings held on or about June 30, 2008, from among all eligible entries received per Participating System. The drawings will be conducted under the supervision of the Administrator, an independent judging organization. Decisions of the Sponsor are final on all matters relating to this Sweepstakes. Potential Grand Prize Winner(s) will be notified by phone, email and/or express mail on or about July 9, 2008 and will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (“Release”) except where prohibited by law. The Release must be received by Sponsor within five (5) days of Grand Prize Winner’s receipt of the Release or prize may be forfeited and an alternate winner selected. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. Entrant information will not be used for any other purpose other than winner selection.
4. PRIZES AND ODDS OF WINNING: One (1) Grand Prize winner per Participating System will be awarded a 4-day/3-night trip for winner and a guest to Los Angeles, CA, the “home of the stars”. Each Grand Prize package includes round trip coach class air transportation for two (2) from a major airport near the winner’s residence (Sponsor’s choice) to Los Angeles or ground transportation to Los Angeles for winners within Los Angeles Country, ground transportation to/from the airport/hotel, three (3) night’s hotel accommodations (based on double occupancy) (Sponsor’s choice), private charter to Catalina Island to enjoy either an island tour or a snorkeling tour and a catered barbecue with Tori and Dean (Estimated Retail Value (“ERV”): $4,750 each). Total ERV of all Grand Prizes is dependent upon the number of Participating Systems agreeing to participate. Odds of winning a Grand Prize are dependent upon the total number of eligible Entries received during the entire Promotion Period for each Participating System. Trip packages do not include insurance of any kind (e.g., automobile, travel accident, general liability, property damage, and medical insurance), taxes, telephone charges, personal expenses, gratuities, incidental charges, or any other item not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the Prize Winner(s). The Actual Retail Value (“ARV”) of travel prizes may vary depending upon the point of departure, destination and fare fluctuation. Grand Prize Winner(s) and his/her travel companion must be available to travel at a time determined by Sponsor, between September 1, 2008–September 30, 2008 (Sponsor’s choice), or prize will be forfeited and, at Sponsor’s sole discretion, an alternate winner selected. Grand Prize Winner(s) must confirm available travel dates and flight times selected by the Sponsor at least four (4) weeks prior to travel dates. No extension or change of trip dates are permitted once Sponsor has confirmed trip dates. Travel companion must be 21 years of age or older at date of travel. No transfer, substitution or cash equivalent for any prizes, except at Sponsor's sole discretion, due to prize unavailability for any reason, and only then for a prize of equal or greater value. Each Grand Prize Winner and his/her travel companion must travel together on the same itinerary and must have valid travel documents prior to departure. Airline carrier’s regulations and conditions and any other restrictions and blackout dates may apply to Grand Prize travel. Each Grand Prize Winner’s travel companion must sign and return a Release of Liability/Publicity Release prior to the issuance of travel documents, except where prohibited by law. Limit one prize per person/household.
5. GENERAL: Sweepstakes is governed by the laws of the State of New York, with venue and jurisdiction in New York County, NY and all claims must be resolved in the courts of New York County, NY. This is a promotion sponsored by NBC Universal Television Networks Distribution on behalf of Oxygen. Prior to registering on the oxygen.com website, you should review its Privacy Policy. By entering, entrants/winners agree: (1) to release Sponsor and its Agents from all liability, loss or damage arising out of their participation in the Sweepstakes and with respect to their acceptance and use/misuse of the prizes; (2) to be bound by the Official Rules; (3) that the decisions of the Administrator are final and binding on all matters relating to the Sweepstakes; and (4) to the use of their names and likeness for advertising and promotional purposes in all media worldwide (including online) without additional compensation, except in TN and where otherwise prohibited by law. Winners are responsible for all federal, state and local taxes. Winners will be issued a 1099 tax form for the ARV of their prizes. Sponsor and its Agents, and all others associated with the development and execution of this Sweepstakes shall not be responsible or liable for damages, losses or injury resulting from this Sweepstakes or the acceptance or use/misuse of any prize.
