Kesha Drops Suit Against Dr. Luke In California, Pursuing Case In NYC
"My fight continues. I need to get my music out. I have so much to say."
It had seemed, for a while, that Kesha's legal battles had reached a kind of stalemate—last we had heard was that Our Lady of Catchy White Girl Rap had had her case against her producer and alleged abuser Dr. Luke dismissed by a judge with some weird and backwards opinions about sexual assault. Although she has since gone on to perform some truly inspiring material and plans on touring with a new band, Kesha has not made much legal headway in her attempts to be released from her appalling record label. Now, our hero seems to be dropping her case against her controlling producer in California, in the hopes of pursuing a stronger suit in New York City.
More specifically, Kesha will be appealing a decision made by a judge who dismissed her case against Dr. Luke in April. Her case against Luke in California had accused the prolific pop writer of a handful of things, including sexual assault and battery, sexual harassment, and gender violence. Jezebel's Aimée Lutkin (who also writes for Oxygen) summarizes the situation succinctly: "Suits were pending bicoastally once Dr. Luke filed a counter-suit against Kesha for defamation in New York. Los Angeles Supreme Court Judge, Barbara M. Scheper, put Kesha’s case in CA on hold. When Kesha lost in New York and filed her appeal, Judge Scheper still refused to lift her stay. With the cases pending, it would be difficult or impossible for her to release her new album and tour again."
According to Kesha herself, the California case is being abandoned so that she can continue to work on artistic endeavors:
Here's a statement from Kesha's lawyer on the subject: "Kesha has dismissed her California action without prejudice while she pursues her appeal and other legal claims in the New York courts... Kesha is focused on getting back to work and has delivered 28 new songs to the record label. We have conveyed to Sony and the label Kesha’s strong desire to release her next album and single as soon as possible."
And here's a retort from Dr. Luke's people, who want to pursue legal action against Kesha (Jesus Christ...) for damages: "If Kesha is voluntarily dismissing her claims in the California case, it is because she has no chance of winning them. Earlier this year, she lost her meritless counterclaims against Dr. Luke in the New York Action. Recently, the California Court invited Dr. Luke and the other defendants to move to dismiss Kesha’s claims in that action. Kesha never should have brought her false and meritless claims against Dr. Luke in any court. Dr. Luke’s defamation and other claims against Kesha are still proceeding."
What Kesha's situation reveals about the nightmarish way our justice system is bias against women is actually astoundingly terrifying.
