A Glasgow man went free in March after admitting to having slept with a 12-year-old girl.
According to the HuffPost, Daniel Cieslak (then 19) believed the girl he met at a taxi stand at 4am back in 2015 was 16 years old. The victim is now speaking out.
“I do not consider there is any need for, or public interest in, punishment. To do so would in my view be disproportionate given the nature of criminal culpability here," shared the judge at the time of the ruling. Judge Lady Scott saw images of the girl on surveillance video and thought she looked older. A taxi driver testified that the girl appeared to be 20. “For what it is worth my impression from viewing the victim on the CCTV footage on assessment by appearance that the victim was over 16 years of age would be a reasonable one," said Scott.
According to the Mirror, the victim says she had been drinking heavily prior to meeting Cieslak, and she was unconscious at the time of the sex. “It was said that I consented but how can someone consent when they can’t even talk?" she asks in a new letter. She adds that she tried to kill herself following the incident.
The High Court has faced backlash following the letter.
