Convicted Killer Allegedly Shoots Girlfriend To Death In Front Of Their Young Son On Christmas

A Pennsylvania man previously convicted of murder is accused of shooting his girlfriend to death on Christmas in front of their young child.

Police were called to a home in Hagerstown, Maryland during the evening hours of the holiday after receiving a report of a gunshot victim; when they arrived on the scene they found Tristen Shifflet, 37, suffering from a shot to the neck, according to a press release from the Hagerstown Police Department. She was transported to a nearby hospital where she died.

Investigators allege her boyfriend Justin Kyle Marshall, 34, shot her during a dispute, striking her in the neck."

The couple shared a ”young child” together, according to police. That child, a boy, along with 10 other loved ones were at the home when the shooting happened, The Herald-Mail reports.

Marshall, who lives in Greencastle, Pennsylvania, allegedly fled the scene and traveled to West Virginia before first responders arrived. He was arrested in Berkeley County, West Virginia hours later.

This is not the first time that Marshall has allegedly gotten violent with the victim. The Pennsylvania State Police had an active arrest warrant for Marshall for assault “in a separate incident involving Shifflet,” police stated. 

Marshall was also convicted of second-degree murder in 2005 for a Hagerstown homicide one year prior, according to police. Marshall and a co-defendant were both sentenced to 25 years in prison for the beating death of 46-year-old Curtis Eugene Hill Sr., according to the Herald-Mail. Marshall took a plea deal and was granted parole after serving half of his sentence.

He had only been out of prison for about two years before the Christmas shooting.

Child Protective Services has taken custody of Marshall and Shifflet’s son and made further arrangements for his housing. 

Marshall has been charged with with first-degree murder and related charges for the death of Shifflet. He is being held without bail, according to online jail records. It’s not clear if he has a lawyer.
