Mom Walks In On Babysitter Molesting 3-Year-Old Daughter, Police Say

James Delavega, 50, now faces an enhanced charge of aggravated sexual assault of a child that carries a minimum sentence of 25 years if convicted.

A Texas man has been arrested after police say he was caught in the act of molesting a 3-year-old girl he was babysitting. The victim's mother walked in on the alleged sex act and called police.

James Delavega, 50, had been babysitting three children on Tuesday night while the victim's mother and her friend, who was Delavega's adult daughter, went out for the night.

When the women returned home they found Delavega performing a sex act on the 3-year old, Anna Police Chief Jeff Caponera told the Dallas Morning News.

Caponera declined to give details about the act but told CBS11 it was "quite honestly, disgusting."

After detectives arrived at the scene they "determined there was enough probable cause" to arrest Delavega, according to a statement from police on Facebook.

"Another child sexual predator taken off our streets by the efforts of your Anna Texas Police Department," the Anna police wrote in the statement.

Delavega faces an enhanced charge of aggravated sexual assault of a child. Under a 2007 Texas law, the enhancement to the charge is added in cases involving a victim of a very young age and carries with it a prison sentence of 25 years to life if convicted, according to the Dallas Morning News.

Delavega, who is being held without bond, has no known previous criminal history in the Dallas area.

CBS11 was able to reach out to the suspect's son who said family members were surprised and shaken by the charges against him.
