Official Rules
June 4, 2021 – June 6, 2021
PRELIMINARY INFORMATION: No purchase necessary. A purchase will not improve your chances of winning. Void where prohibited. Oxygen’s CrimeCon Challenge: The Hunt Is On Contest (“Contest”) will begin on June 4, 2021 at 8:00 A.M. CT and end on June 6, 2021 at 2:00 P.M. CT (“Contest Period”). All times in the Contest refer to Central Time (“CT”). Contest is subject to all applicable federal, state and local laws. Odds of winning depend upon the number of eligible Entries (defined below) received. PrizeS do not include transportation, accommodations or parking.
CONTESTANTS should not expose themselves or others to any dangerous or harmful behavior OR activity at any time during this CONTEST. CONTESTANTS agree to abide by all traffic, safety, and other applicable laws.
ELIGIBILITY: Open only to permanent, legal United States residents who are physically residing in one (1) of the forty-eight (48) continental United States or the District of Columbia (excluding Alaska, Hawaii, Puerto Rico, Guam, the Virgin Islands and other United States territories), and who are eighteen (18) years of age or older, of the age of majority in their state of residence, and who have either an in-person ticket or a virtual ticket to CrimeCon 2021 (“Event”) as of the start of the Contest Period. Officers, directors, and employees of Contest Entities (as defined below), The Music Syndicate, Freeze Tag, Inc., members of these persons’ immediate families (spouses and/or parents, children, and siblings, and each of their respective spouses, regardless of where they reside), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter or win the Contest. Contest Entities, as referenced herein, shall include Oxygen Media, LLC, 30 Rockefeller Plaza, New York, NY 10112, NBCUniversal Media, LLC, 30 Rockefeller Plaza, New York, NY 10112 (collectively, “Sponsors”), Red Seat Ventures LLC, 129 W. 29th Street, Room 600N, New York, NY 10001 (“Prize Provider”) and each of their respective parent, subsidiary, and affiliate companies, and their administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Contest.
ENTRY AND WINNER DETERMINATION: To enter the Contest, during the Contest Period, visit the application store on your mobile device and search for “Eventzee”. Follow the instructions to download and install the Eventzee app (the “Eventzee App”). Once downloaded, open the Eventzee App and either 1) follow the provided instructions to create an account by entering your email, username and password, or 2) login to your existing Eventzee App account. The Contest will consist of a scavenger hunt involving the answering of trivia questions, solving puzzles, and submitting pictures at the Event, either in-person or virtually (collectively, “Games”, each a “Game”), using the Eventzee App (“Scavenger Hunt”). Once you are logged in to the Eventzee App, enter the Event code you received when purchasing your ticket to either the in-person Event or virtual Event and participate in at least one (1) Game within the Scavenger Hunt (collectively, the “Entry”).
The Contest will be separated by ticket type such that all in-person entrants will compete against each other and all virtual entrants will compete against each other. For each Game, the Eventzee App will award points to each participating entrant. The combination of all Games played by any individual entrant during the Contest Period will comprise their total score of 0 to 100 (“Score”). The in-person entrant with the highest Score and the virtual entrant with the highest Score will be deemed the grand prize winners (collectively, “Grand Prize Winners”, each a “Grand Prize Winner”). The four (4) in-person entrants and four (4) virtual entrants with the most points following the Grand Prize Winners will be deemed the prize pack winners (collectively, “Prize Pack Winners”, each a “Prize Pack Winner”). The fifteen (15) in-person entrants and fifteen (15) virtual entrants with the most points following the Prize Pack Winners will be deemed the promo code winners (collectively, “Promo Code Winners”, each a “Promo Code Winner). If no entrant can complete a specific Game, within a reasonable time, as determined by Sponsors in their sole discretion, Sponsors may choose to remove the Game, modify the Game or provide additional clues. In the event that two (2) or more entrants have the same Score, the entrant with the shortest time to complete all Games within the Scavenger Hunt will be deemed to have the higher Score for tie-breaking purposes. All Entries become the properties of Sponsors and will not be acknowledged.
NOTE: To participate, you must have an iPhone or Android device running a mobile operating system that is compatible with the current version of the Eventzee App. If you choose to submit your Entry via your web-enabled mobile device, data rates may apply. See your wireless service provider for details on rates and capabilities.
Limit one (1) Entry per person during the Contest Period. Entries must be received before June 6, 2021 at 2:00 P.M. CT to be eligible for the Contest. Sponsors’ computer shall be the official timekeeper for all matters related to this Contest. Entries that are incomplete, garbled, corrupted, fraudulent, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. “Authorized account holder” of an email address is defined as the person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the email address submitted at the time of Entry. Entry constitutes permission (except where prohibited by law) to use entrant’s name, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.
Any attempt to use multiple names or email accounts or other tactics to register or enter more than the stated limits may result in the disqualification of entry by Sponsor from the Contest and all associated registrations and/or entries will be void. Registrations and entries generated by script, macro or other automated means or with the intent to subvert the registration or entry process will be void.
PRIVACY: Entrants will have the opportunity to receive information from Sponsors and/or selected partners by checking the appropriate box(es). If, at any time, you no longer wish to receive materials from Sponsors or our partners, please go to our privacy policy, located at https://www.nbcuniversal.com/privacy, or the applicable partner’s privacy policy and follow the procedures indicated.
RECORDING: Sponsors, in their sole discretion, may choose to record and/or broadcast the appearance of participants at the Event, on Oxygen and/or in advertising and promotional materials (collectively, “Materials”). By entering the Contest, participants agree to be filmed, photographed, identified and/or included in ant Materials, in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval. If Sponsors, in their sole discretion, elect to incorporate any audio and/or video recording of participants (the “Recording”) into any Materials, the taping and/or the Recording will not be considered an employment opportunity, and participants will not be entitled to compensation or credit thereof. Sponsors will determine the nature of the Recording in their sole discretion. If the Recording is broadcast, such broadcast will be at a time, for a length of time, and on a date determined by Sponsors in their sole discretion. Winners may be required to return completed and signed appearance releases, confidentiality agreements and such other documents as may be required by Sponsors. Failure of a Winner to complete and execute these documents in a timely manner, as determined by Sponsors in their sole discretion, may cause such Winner to be disqualified and any potential Prize to be forfeited. The content of the Recording as, and if, finally exhibited and the number of exhibits and re-airs thereof, if any, will be determined by Sponsors in their sole discretion. Participants will not have a right of review, notice, or approval of the content of the Recording or any exhibition or exploitation thereof. These Official Rules and the Contest itself are neither a contract nor an application for employment.
WINNER NOTIFICATION: Decisions of Sponsors and/or their representatives are final and binding with respect to all matters related to the Contest. Winning is subject to verification of eligibility. Sponsors will make two (2) attempts to notify each potential Winner at the email address used to sign up for the Eventzee App. Winning is subject to verification of eligibility. Sponsors may share each potential Winner’s name and contact information with Contest Entities and/or any prize supplier, as applicable, if necessary. Potential Winners will each be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Contest Documents”) within five (5) days of such notification. Noncompliance within this time period, with these Official Rules or the return or inability to deliver any Prize or Prize notification may result in disqualification and, at Sponsors’ discretion, and time permitting, an alternate potential Winner may be selected from among all eligible remaining Entries based on the next highest score accrued. Limit one (1) Prize (defined below) per family or household.
PARTICIPATION CONDUCT: A participant may be asked or directed to leave, or be removed from, the Event or other premises where the Contest is being conducted and/or disqualified from participating in the Contest, at the sole discretion of Sponsors, for any reason at any time, including but not limited to creating an unauthorized disturbance, interruption, or unnecessarily rough physical contact; being or potentially being a physical or mental threat to the well-being of himself/herself, any other participant, or Sponsors’ representatives at an Event (“Event Staff”); using profanity or demonstrating any lewd or sexually suggestive gestures or full or partial nudity; creating the potential for death, disability, injury, property damage or any other negative incident; or performing any act that may be considered dangerous, harmful, unhealthy, unsafe, or inappropriate or may be considered by any federal, state, or local statute or ordinance as constituting a criminal act. At the sole discretion of Sponsors, a participant’s disqualification, removal, or failure or refusal to comply with any request or direction of Sponsors or Event Staff will result in forfeiture of any Prize that may have been awarded.
By participating, each participant (a) understands the Sponsors have not arranged for and do not carry any insurance of any kind for participant’s benefit and that participant will be solely responsible for obtaining and paying for any medical, life, accident, automobile, property or other insurance relative to his/her participation in Contest; (b) agrees that he/she will obey all traffic, safety and other applicable laws and will not speed or otherwise expose himself/herself or any other individual, whether participating in the Contest or not, to harm or danger of any kind; (c) agrees to release and hold harmless the Released Entities (defined below) from any injuries, losses or damages of any kind, including, without limitation, death, to persons, or property resulting in whole or in part, directly or indirectly, from participating on Contest; and (d) agrees to indemnify the Released Entities (defined below) from any losses, liabilities or expenses, including, without limitation, reasonable attorneys’ fees, resulting from any claims, proceedings or investigations arising from or in connection with participant’s participation in Contest or compliance or non-compliance with these Official Rules.
PRIZE: There will be two (2) grand prizes awarded (collectively, “Grand Prizes”, each a “Grand Prize”) to the Grand Prize Winners; one (1) Grand Prize will be awarded to each Grand Prize Winner. There will be eight (8) prize packs awarded (collectively, “Prize Packs”, each a “Prize Pack”) to the Prize Pack Winners; one (1) Prize Pack will be awarded to each Prize Pack Winner. There will be thirty (30) promo codes awarded (collectively, “Promo Codes”, each a “Promo Code”) to the Promo Code Winners; one (1) Promo Code will be awarded to each Promo Code Winner.
Each Grand Prize will consist of two (2) standard in-person tickets for the Grand Prize Winner and a guest (“Guest”) to attend CrimeCon 2022 (“CrimeCon 2022”).
Each Prize Pack will consist of a package of four (4) items including (including 1 hat, 1 shirt, 1 set of wine glasses, 1 sherpa blanket) from ShopOxygen.com as determined by Sponsors in their sole discretion.
Each Promo Code will consist of a twenty-five dollar ($25) voucher for ShopOxygen.com.
The Grand Prize, Prize Packs and Promo Codes will be referred to as “Prize” or “Prizes” herein.
Prize will be awarded “as is” with no warranty or guarantee, either express or implied by Sponsors. Prize is subject to certain terms and conditions as specified by issuer. Restrictions may apply. PRIZE DOES NOT INCLUDE ACCOMMODATIONS, PARKING, OR TRANSPORTATION BEYOND THAT SPECIFIED ABOVE.
Estimated Retail Value (“ERV”) of the Grand Prize is seven hundred fifty-eight dollars ($758). ERV of Prize Pack is one hundred twenty-nine and 80/100 dollars ($129.80). ERV of Promo Code is twenty-five dollars ($25). Total ERV of all Prizes is three thousand three hundred four and 40/100 dollars ($3,304.40). Actual Retail Value (“ARV”) of Prizes may vary. Any difference between ERV and ARV will not be awarded. For any Prize with an ARV of six hundred dollars ($600) or greater, Sponsors will furnish an Internal Revenue Service Form 1099 to Winner for the ARV of Prize for the year in which Prize was won.
All details of Prizes will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prizes are the sole responsibility of Winners. Prizes cannot be transferred by Winners or redeemed for cash and are valid only for the items detailed above, with no substitution of Prizes by Winners. If a Prize is unclaimed within a reasonable time after notification from Sponsors, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible entries at Sponsors’ sole discretion.
Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of Prize due to reasons beyond Sponsors’ control, and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of CrimeCon 2022 is subject to change. CrimeCon 2022 is subject to cancellation. Winner and Guest, if any, must comply with all applicable venue rules and regulations in connection with Prize. If a Winner chooses to attend the Event with no Guest, the remaining elements of Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. Guest, if any, may be required to execute and return releases of liability and, where legal, publicity releases (collectively, “Guest Documents”), which must be returned with the Contest Documents, or Guest portion of the Prize will be forfeited. If any Guest(s) do(es) not comply with any of the obligations specified in these Rules which are applicable to them, Sponsor reserves the right to refuse to provide that portion of the Prize allocated for the applicable Guest(s)’ use.
Prize fulfillment and related activities will take place on a date and time designated by Sponsors and only when and in a manner that it is safe to do so, as determined by Sponsors in their sole discretion in consultation with appropriate health and safety experts. Winner and Guest, if any, must follow all instructions given by representatives of Sponsors at all times.
If required, Winner and Guest, if any, must cooperate with Sponsors’ inquiries related to public health matters and follow Sponsors’ related rules and processes, including, but not limited to, disclosures or processes recommended or required by public health authorities to protect the health and safety of Winner, Guest, and others. Winner and Guest, may be subject to health screenings (which may include, but are not limited to, temperature checks, symptom screening, lab testing, and/or other medical exams) to be conducted by Sponsors or their designee(s) prior to or during the fulfillment of the Prize and related activities. Failure to fully comply with Sponsors’ requests or requirements may result in forfeiture of the Prize or portions thereof, as determined in Sponsors’ discretion.
During a period starting approximately four (4) weeks before participation in activities related to the Prize and ending approximately four (4) weeks after participation in the last of such activities (such period(s) subject to change based on medical guidance, and/or policy guidance), Winner and Guest, may be required to inform Sponsors, upon Sponsors’ request, about matters relating to communicable illnesses and safe fulfillment of the Prize and related activities, including, without limitation: (a) medical symptoms; (b) travel history; (c) recent contact with others who have displayed symptoms of or have otherwise been confirmed to have a communicable illness; and (d) active public health orders issued by a civil authority or any similar public health mandate (e.g., order to quarantine, order to stay at home, order to disclose communicable illness) to which Winner and/or Guest are subject.
CONDITIONS: By entering the Contest, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Contest Entities, The Music Syndicate, Freeze Tag, Inc. and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Contest and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on the Eventzee App and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Contest itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Contest at Sponsors’ sole discretion.
ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Contest or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Contest. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Contest or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winners in a random drawing from among all eligible, non-suspect entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted on the Eventzee App. Sponsors may prohibit any entrant or potential entrant from participating in the Contest, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion). Sponsors reserve the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest.
DISPUTES: The Contest is governed by, and will be construed in accordance with, the laws of the State of New York, and the forum and venue for any dispute shall be in New York, New York. If THE controversy or claim is not otherwise resolved through direct discussions or mediation, it shall THEN be resolved by FINAL AND binding arbitration administered by JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof (“JAMS Rules”). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be experienced and licensed to practice law in new york. All proceedings brought pursuant to this paragraph will be conducted in the County of new york. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
